In U.S. v. Morgan , a Kansas federal judge ruled that the Second Amendment forbids the government from banning the possession of machine guns.

Peter Bergen : This is a new frontier for Second Amendment: Federal law has heavily regulated those weapons since 1934 , soon after they first became commercially available, and has prohibited private ownership since 1986 (with exception for those guns lawfully owned prior to that time).

David Rothkopf : Recent research shows judges appointed by Donald Trump have been friendly to Second Amendment claims.

He says it's no great surprise that Morgan was decided by a judge appointed by the former president.

He writes that the federal appeals court overseeing Kansas will probably reverse the decision and agree with every other court to review the issue that machine guns are not Second Amendment protected firearms.

Rothkowski : Until the Court is prepared to reverse course, we can expect increasingly extreme decisions.
